ބަރުލަމާނީ ނިޒާމް

ބަރުލަމާނީ ނިޒާމަކީ އެނިޒާމެއްގައި ސަރުކާރު ހިންގާ އެންމެ އިސްފަރާތާއި (ބޮޑުވަޒީރު) ޤާނޫނުހަދާ މަޖްލިހުގެ (ލެޖިސްލޭޗަރ) އަޣުލަބިއްޔަތު ލިބިފައިވާ ޕާޓީއާއި އެކުވެ މަސްހުނިވެގެން އުފެދޭ ވެރިކަމުގެ ނިޒާމަކައް ކިޔާ ނަމެކެވެ. މިނިޒާމުގެ ތެރެއިން އުފެދިގެންއަންނަ ސަރުކާރަށް ކެބިނެޓް ސަރުކާރު (ކެބިނެޓް ގަވާންމަންޓް) ނުވަތަ ބޮޑުވަޒީރު ސަރުކާރޭ (ޕްރައި މިނިސްޓީރިއަލް ގަވަރމަންޓް) ވެސް ކިޔައެވެ. މިނިޒާމް އެންމެ ފުރިހަމައަށް ގާއިމްވެފައިވާ އެއްގައުމަކީ އިނގިރޭސިވިލާތެވެ. އަދި މިނިޒާމަކީ ދުނިޔޭގަ ކުރިއަރާފައިވާ ވަރަށްގިނަ ޤައުމުތަކެއްގައި ވަރަށް ކާމިޔާބާއެކު ހިނގަމުން އަންނަ ވެރިކަމުގެ ނިޒާމެކެވެ.

ބަރުލަމާނީ ނިޒާމެއްގެ ދަށުން ހިނގާ ވެރިކަމުގެ ނިޒާމެއްގައި ހުންނާނެ މައިގަނޑު ސިފަތަކަކީ:

1- ރަމްޒީ ވެރިއަކު ހުރުން – މިނިޒާމުގައި ދައުލަތުގެ ވެރިއެއްގެ ހައިސިއްޔަތުން ނުވަތަ ދައުލަތް ތަމްސީލު ކުރާ ފަރާތެއްގެ ގޮތުގައި (ރައީސަކު ނުވަތަ ރަސްކަލަކު) ހުރެއެވެ. މިއީ ހަމަނަމެއްގައި ހުންނަމީހެކެވެ. އެމީހަކީ އެއްވެސް ބާރެއް ނުފޫޒެއް ހިންގޭފަދަ ފަރާތެއް ނޫނެވެ. އެހެން ނަމަވެސް ސަރުކާރުގެ ހުރިހާކަމެއް ހިންގާނީ ދައުލަތުގެ ވެރިޔާގެ (ރައީސް / ރަސްގެފާނު) ނަންމަތީ ބޮޑު ވަޒީރަށް ދެއްވާފައިވާ ބާރުތަކުގެ ތެރޭގައެވެ. މިސާލަކަށް އިނގިރޭސި ވިލާތުގައި އިންތިހާބުގައި ކާމިޔާބުހޯދާ ޕާޓީގެ ލީޑަރު އެއީ ބޮޑުވަޒީރުކަމުގައި ހަމަޖައްސައި ރާނީ އަތުގައި ނަމެއްގެ ގޮތުގައި އޮތްބާރުތައް ބޮޑުވަޒީރަށް ދެއްވައި ބޮޑުވަޒީރަކީ އެކަމަނާގެ އެންމެ އިސް އަދި އެއްވަނަ ވަޒީރުކަމުގައި ހަމަޖައްސައެވެ. އަދި އެބޭފުޅާއަށް ވަކި މުއްދަތެއް ތެރޭ ޕާޓީ ކެބިނެޓް އެކުލަވާލުމަށް ރާނީ މުހުލަތެއް ދެއްވާނެއެވެ. އަދި މި މުއްދަތުގެ ތެރެއަށް ބޮޑުވަޒީރު އޭނާގެ ކެބިނެޓުގައި ހިމެނިވަޑައިންނަވާ ބޭފުޅުންގެ ނަންތައް ރާނީއަށް އަރުވާނެއެވެ. އެނަންތައް އެރުވުމުން އެއްވެސް ޝަކުވާއެއްނެތި އެނަންތައް ގަބޫލުކުރައްވާނެއެވެ. ހަމައެއާއިއެކު އެއީ ރާނީގެ ވަޒީރުން ކަމުގައި ހަމަޖެހޭނެއެވެ. ޖުމްލަގޮތެއްގައި ބުނާނަމަ މިފަދަ ނިޒާމެއްގައި ދައުލަތުގެ ވެރިޔާ ފުރައްވަމުން ގެންދަވާނީ ރަމްޒީ މަގާމެކެވެ.

2- ބޮޑުވަޒީރުގެ ވެރިކަން – ހަގީގީ ވެރިކަން ހިންގުމުގެ ބާރު ނުވަތަ (އެގްޒެކެޓިވް އޮތޯރިޓީ) އޮންނާނީ ބޮޑުވަޒީރު އަތުގައެވެ. ސަރުކާރުގެ އެންމެ އިސް ތަރުޖަމާނާއި ކެބިނެޓްގެ އެންމެ އިސް ވެރިޔާއާއި އަދި މަޖްލީހުގެ އަޣުލަބިއްޔަތު ލިބިފައިވާ ޕާޓީގެ ވެރިޔަކީވެސް ބޮޑު ވަޒީރެވެ. އެހެން ކަމުން ބޮޑުވަޒީރު ކަމެއް ނިންމެވުމުން އެއޮންނަ ހަމަތަކެއްގެ މަތިން އެކަން އިޢުލާން ކުރާނީ ދައުލަތުގެ ވެރިޔާއެވެ. މިސާލަކަށް ގައުމަކާއި ދެކޮޅަށް ހަނގުރާމަ ކުރަން ނިންމާނީ ބޮޑު ވަޒީރެވެ. ނަމަވެސް ދައުލަތުގެ ފަރާތުން އެ ނިންމުން އިޢުލާނު ކުރާނީ ރާނީއެވެ.

3- ސިޔާސީ ހަމަޖެހުން – ބޮޑުވަޒީރަކީ ރައްޔިތުންގެ މަޖިލީހުގެ ފުރިހަމަ އަޣުލަބިއްޔަތު ލިބިފައިވާ ޕާޓީގެ ލީޑަރެވެ. އަދިހަމަ ހުރިހާ ވަޒީރުންނަކީވެސް ބޮޑުވަޒީރުގެ ޕާޓީގެތެރެއިން ހޮވާލެވޭ ޤާނޫނު ހަދާ މަޖްލީހަށް އިންތިހާބްވެފައިވާ މެންބަރުންނެވެ. ނަމަވެސް މަޖްލީހުގެ ފުރިހަމަ އަޣުލަބިއްޔަތު އެއްވެސް ޕާޓީއަކަށް ނުލިބޭނަމަ ގިނަ ޕާޓީތަކެއް އެކުވެގެން "އެއްބައިވަންތަކަމުގެ ސަރުކާރެއް" އެކުލަވާލާ މަޖިލީހުގެ އަޣުލަބިއްޔަތު ހޯދިދާނެއެވެ. މިފަދަ އެއްބައިވަންތަކަމުގެ ސަރުކާރެއްގައި އެހެންޕާޓީތަކަށް ނިސްބަތްވާ މެމްބަރުން ވަޒީރުންގެ ގޮތުގައި ތިބޭނެއެވެ. ނަމަވެސް ބޮޑުވަޒީރު ނިސްބަތްވާ ޕާޓީގެ ވަޒީރުން އެހެން ޕާޓީތަކަށް ނިސްބަތްވާ ވަޒީރުންނަށް ވުރެން ގިނަވުމުން އެ ހިތްހަމަޖެހުން ބޮޑުވަޒީރަށް ލިބޭނެއެވެ. އަދި ސަރުކާރު ހިންގެވުމުގެ ކަންތައްތައް ނިންމެވުމުގައި ބޮޑުވަޒީރަށް ފަސޭހަވެ ހިތްވަރު ލިބެއެވެ.

4- ވަޒީރުން ޒިންމާދާރުވެ އެކައްޗެއްކިޔުން – މިނިޒާމުގައި އެންމެ ފާހަގަކޮށްލެވޭ އެއް ސިފަޔަކީ ވަޒީރުން ގާނޫނުހަދާ މަޖިލީހަށް ފުރިހަމައަށް ޖަވާބުދާރީވެ ޒިންމާދާރުވާންޖެހޭކަމެވެ. ހަމަ އެއާއިއެކު ސަރުކާރުގެ ސިޔާސަތަކާއި ދެކޮޅަސް އެއްވެސް ވަޒީރަކަށް އެ ސިޔާސަތެއް ކުށްވެރިކޮށް ފާޑެއް ނުކިޔޭނެއެވެ. އެހެނެއްކަމަކު ވާހަކަ ދައްކަވަންޏާ ދައްކަވަންވާނީ އެސިޔާސަތެއް ދިފާޢު ކޮށްފައެވެ. ނޫނީ ޖެހޭނީ ހަނުހުންނަވާށެވެ. ދެންނޫނީ ޖެހޭނީ ވަޒީރުކަމުން އިސްތިޢުފާ ދޭށެވެ. މިސާލަކަށް ބޮޑު ވަޒީރު މާރގްރެޓް ތެޗަރގެ ދުވަސްވަރު އެކަމަނާގެ ޑިފެންސް މިނިސްޓަރ، މައިކަލް ހެސްލައިން އެކަމަނާ "ވެސްޓް ލޭން އެފެއަރ"ގެ މައްސަލަ ނިންމެވި ގޮތާއި ހިތްހަމަ ނުޖެހި އެވާހަކަ އާންމުންގެ ތެރޭ ދައްކަވައި ސަރުކާރުގެ ވަރަށް މުހިއްމު ލިޔުމެއް ލީކު ކޮށްލެއްވި އެވެ. އަދި ހަމައެއާއި އެކު 1986 ވަނަ އަހަރު ވަޒީރުކަމުން އިސްތިޢުފާދެއްވިއެވެ.

5- ރަނގަޅު ހަރުދަނާ އިދިކޮޅު ޕާޓީއެއް – މަޖިލީހުގެ އަޣުލަބިއްޔަތު ލިބޭ ޕާޓީ ސަރުކާރު އެކުލަވާލާއިރު ދެންހުރި ހުރިހާ ޕާޓީ ތަކެއްވެގެން އޮންނަންވާނީ ރަނގަޅު ހަރުދަނާ އިދިކޮޅު ޕާޓީ އެއް އެކުލަވާލާފައެވެ. މިކަމުގައި އިދިކޮޅު ޕާޓީތައް ވަރަށް "އިހްލާސްތެރިކަމާއި އެކު" އިދިކޮޅު ހަރަކާތްތައް ކުރިއަށް ގެންދަންވާނެއެވެ. އެހެން ނޫނީ ހަގީގީ އިދިކޮޅު ޕާޓީ އެއް އޮވެގެން ރައްޔިތުންނަށް ލިބެންޖެހޭ ފައިދާއާއި ލާބައެއް ނުލިބޭނެއެވެ. އިދިކޮޅު ޕާޓީގެ އަސްލު މަޤްސަދަކަށްވާންވާނީ ވެރިކަމުގައި އޮތް ޕާޓީ އަށް ގާނޫނީ ގޮތުން ލިބިފައި އޮތް ބާރު އޭގެ ނުހައްގު ގޮތުގައި ބޭނުން ކުރަމުންދޭތޯ ބަލާ ޗެކުކުރުމެވެ. އަދި އެފަދަގޮތަކަށް ބޭނުންކުރާނަމަ އެކަން ހުއްޓުވާ މަޖިލީހުގެ ސަމާލުކަމަށް އެކަން ގެނައުމެވެ. މި ގޮތުން ސަރުކާރުން ރައްޔިތުންނަށް ކޮށްދޭންޖެހޭނެ ކަންތައްތަކާއި އިހުމާލުން ނުކޮށް ދޫކޮށްފައި ހުރި ކަންތައްތައް ނަގައި ސަރުކާރަށް "ބިނާކުރަނިވި" ފާޑުކިޔާނެއެވެ. އަދި ހަމަ ސަރުކާރަށް އިތުބާރެއް ނެތް ކަމުގެ ވޯޓެއް މަޖިލީހުން ފާސްވެއްޖެ ހިނދެއްގައި ސަރުކާރު އުވާލުމަށް ބޮޑު ވަޒީރު އަމުރު ނެރުއްވާނެއެވެ. އެކަން ދައުލަތުގެ ވެރިއަކަށް ހުންނަމީހަކު ދައުލަތުގެ ފަރާތުން އިއުލާން ކުރައްވާނެއެވެ.

މަތީގައި ބަޔާން ކުރެވިފައި އެވަނީ ބަރުލަމާނީ ނިޒާމެއްގައި އެކުލެވިގެންވާ މައިގަނޑު ސިފަތަކެވެ. މިފަދަ ސަރުކާރެއްގައި ވަޒީރުން (ކެބިނެޓް) ވަކިހަމަތަކެއްގެ ތެރެއިން ޕާލިމެންޓަށް ވަރަށް ވަރުގަދަޔަށް ޖަވާބު ދާރީ ވާންޖެހޭނެއެވެ. ހަމަ އެޔާއި އެކު ރައްޔިތުންނަށް ވެސް މެއެވެ. މީގެ މާނައަކީ މަޖްލީހުގައި ރައްޔިތުން އިންތިހާބު ކޮށްފައިވާ މަންދޫބުންތަކެއް އެކަނި (އިނިރޭސި ވިލާތުގައި ނަމަ ހައުސް އޮފް ކޮމަންސް) ތިބިތަނަކަށްވެފައި އެތާ އެދައްކާ ވާހަކަތައް އެނގޭނެތީއެވެ. އަދި އެއިވޭ އިވުމަކީ ނުވަތަ އަޑުއަހާ އަޑުއެހުމަކީ ރެޕްރެޒެންޓެޓިވް ޑިމޮކްރަސީގެ އުސޫލުން ހުރިހާ ރައްޔިތުންވެސް އަޑުއަހާ އަޑުއެހުމެކެވެ.

ބަރުލަމާނީ ނިޒާމުގެ ތެރެއިން އުފެދިގެން އަންނަ ސަރުކާރުގައި ވެސް ރަނގަޅު މޮޅުކަންތައް ހުންނަ ބީދައިން ގޯސް ބަލިފައިތަކެއްވެސް ހުރެއެވެ. މިގޮތުން ފުރަތަމަ މިބަލާލަނީ ހުރި މޮޅު ރަނގަޅު ކަންތައްތަކަށެވެ.

1- އެއްވެސް އޮޅުމެއްނެތް ގޮތުގައި މިފަދަ ސަރުކާރެއްގައި ސަރުކާރު ހިންގަވާ އެންމެ އިސް އިދާރާތަކާއި ޤާނޫނުހަދާ މަޖްލީހާއި ދެމެދު ވަރަށް ގާތް އެކުވެރި ގުޅުމެއް އޮންނާނެއެވެ. މިގާތް ގުޅުމުގެ އެންމެ ބޮޑު އަސްލަކީ ސަރުކާރު ހިންގަވަން ހުންނަވާ ވެރިޔާ، ބޮޑުވަޒީރާއި ބޮޑުވަޒީރުގެ ވަޒީރުންނަކީ ގާނޫނުހަދާ މަޖްލީހުގެ މެންބަރުންނަށް ވުމާއި އަދި އަޣުލަބިއްޔަތު ލިބިފައިވާ ޕާޓީގެ ލީޑަރަށް ވުމެވެ. މިހެންކަމުން ގާނޫނުހަދާ މަޖްލީހުގައި ދެކޮޅުވެރިކަމާއި ރުޅިވެރި ކުރިމަތިލުންތަކަކަށް މާބޮޑު ފުރުސަތެއް ނޯންނާނެއެވެ.

2- ސަރުކާރުހިންގަވާ އެންމެ އިސްވެރިޔާ ގާނޫނޫހަދާ މަޖްލީހުގެ ކުރިމަތީގައި ޖަވާބުދާރީވާންޖެހޭނެއެވެ. އެހެންކަމުން ހުރިހާކަމެއް ސަރުކާރު ހިންގަވަން ހުރި ފަރާތް ބޭނުންވާގޮތަށް ނިންމެވުމުގެ ފުރުސަތު ވަރަށް ބޮޑުތަން ކުޑަވާނެއެވެ. މަޖްލީހުގެ މެންބަރުން ކުރާ ސުވާލުތަކަށް ފުރިހަމައަށް އިޖާބަދީ އެ ސުވާލުތަކަށް ފުރިހަމަ ޖަވާބުދޭން ވަޒީރުންނަށް މަޖުބޫރުވާނެއެވެ. ހަމަ އެއާއި އެކީ ސަރުކާރުން ހިންގަވާ ރާވާ މަޝްރޫޢު ތަކާއި ސަރުކާރުގެ ސިޔާސަތާއި ބެހޭގޮތުން މަޖްލީހުގައި ބަހުސް ކުރެވި މަޖްލީހުގައި ސަރުކާރަށް ފާޑުކިޔުންތަކާއި ކުރިމަތިލާން ޖެހޭނެއެވެ. މި ގޮތުން ބައެއްފަހަރު ވަޒީރުންނަށް އަނެއްބައި ފަހަރު މުޅި މިނިސްޓްރީއަށް ފާޑުކިޔުންތައް އަމާޒުވެ، މިނިސްޓަރުން ވެސް އިސްތިއުފާ ދޭންޖެހޭތަން ވެސް އާދެއެވެ. އެހެން ކަމުން ސަރުކާރު އަބަދުވެސް އޮންނާނީ އިދިކޮޅު ޕާޓީން ދީފާނެ ހަމަލާއަކަށް ބިރުންނެވެ.

3- ސަރުކާރަށް އެމީހުން ބޭނުންވާ ނިންމުންތައް (ޑިސިޝަން) އަވަހަށް ނިންމާ ކަންތައްތައް ރާވާ ހިންގަން ފަސޭހަވެއެވެ. އެހެންކަމުން ސަރުކާރުން ބޭނުންވާ ކަންތައްތައް ނުވަތަ ކޮންމެހެން ގާނޫނުހަދާ މަޖިލީހުން ތާއީދު ލިބިގެންނޫނީ ފާސްނުވާނެ ކަންތައްތައް ފަސޭހަކަމާއި އެކު ގާނޫނުހަދާ މަޖްލީހުން ފާސްކުރެއެވެ. އެއީ ކުރިންދެންނެވިހެން ޤާނޫނު ހަދާ މަޖްލީހުގެ ފުރިހަމަ ބާރު އޮންނާނީ ބޮޑުވަޒީރުގެ އަތްޕުޅުގައި ކަމަށް ވާތީއެވެ.

4- ސަރުކާރުން އެއްވެސް ހާލެއްގައި ރައްޔިތުންގެ ތާއީދު ގެއްލޭފަދަކަމެއް ނުކުރާނެއެވެ. އަދި ހަމަ ރައްޔިތުން ނާއުންމީދުވާފަދަ އެއްވެސް އަމަލެއް ނުވަތަ ގަވައިދެއްވެސް ފާހެއް ނުކުރާނެއެވެ. ވަރަށް ގާތުން ރައްޔިތުންގެ އަޑުއަހައި ރައްޔިތުންގެ ޝަކުވާތަކަށް އަވަސް އިޖާބަ ދޭނެއެވެ. އެހެނީ އެޕާޓީގެ ވެރިކަން ދެމިއޮންނާނީ ރައްޔިތުންގެ ތާއީދު ލިބިގެންކަން ދަންނާތީއެވެ.

5- ބަރުލަމާނީ ނިޒާމުގައި ފަސޭހައިން ތަފާތު ހާލަތްތަކަށް އެކަށީގެންވާ ގޮތަށް ސަރުކާރު ބައްޓަން ކުރެވިދާނެއެވެ. މިސާލަކަށް ގައުމަށް ދިމާވާ ކުއްލި މުސީބާތުގެ ވަގުތުގައި ވަރުގަދަ ވާދަވެރިކަން ބޮޑު އިންތިހާބަކަށް ދިޔުމުގެ ބަދަލުގައި އިންތިހާބު ބާއްވާނޭ މުއްދަތެއް ފަހުން ކަނޑައެޅިދާނެއެވެ. މިގޮތުން އިންތިހާބުގެ ތާރީހު ފަސް ކުރާނަމަ ސަރުކާރު ހިންގަވާ އެންމެ އިސްވެރިޔާ (ބޮޑު ވަޒީރު) އެކަން މަޖިލީހަށް ހުށައަޅާ އެންމެހާ މެންބަރުންގެ ތާއީދާށް އެދޭނެއެވެ. ނޫނީ ބޮޑު ވަޒީރުގެ ސަރުކާރާއި އިދިކޮޅު ޕާޓީގެ ލީޑަރުން ގުޅިގެން ކަނޑައެޅިފައިވާ މުއްދަތުގެ ތެރޭގައި ވެރިކަންތަކުގެ ކަންތައްތައް ކުރިއަށް ގެންދާނީއެވެ.

6- ބަރުލަމާނީ ނިޒާމުގައި ވެރިކަމުގައި އޮތް ޕާޓީ ވެރިކަމުގެ ދައުރު ހަމަވުމުގެ ކުރިން އިސްތިއުފާ ދީފިނަމަ މަޖްލީހުގެ އަޣުލަބިއްޔަތު ހޯއްދަވައި އިދިކޮޅު ލީޑަރު ސަރުކާރު އެކުލަވާލުމަށް އެދެފިނަމަ އެފުރުސަތު އިދިކޮޅު ޕާޓީގެ ލީޑަރަށް ދައުލަތުގެ ފަރާތުން ދައުލަތުގެ އެންމެ އިސްވެރިޔާ ދެއްވާނެއެވެ.

ބަރުލަމާނީ ނިޒާމުގެ ތެރެއިން އުފެދިގެން އަންނަ ސަރުކާރުގައި ހުރި އުނި ދެރަ ކަންތައްތައް ބައިވަރެވެ. މިގޮތުން ފާހަގަކޮށްލެވޭ މުހިއްމު ކަންތައްތައް ތިރީގައި މި ފާހަގަ ކޮށްލަނީއެވެ.

1- ބަރުލަމާނީ ނިޒާމުގައި ދިމާވާ އެންމެ ސީރިއަސް މައްސަލައަކީ ތިންބާރު ވަކިކުރާ (ސެޕަރޭޝަން އޮފް ޕަވަރސް) އުސޫލް މުގުރާލުމެވެ. ސަރުކާރު ހިންގާ އެންމެ އިސްފަރާތާއި (ބޮޑުވަޒީރު) ޤާނޫނު ހަދާ މަޖްލީހާއި (ލެޖިސްލޭޗަރ) މި އޮންނަނީ ގުޅި މަސްހުނިވެފައެވެ. އެހެންކަމުން މި ދެބާރު އެއް ފަރާތްތަކެއްގެ އަތްމަތީ އޮންނައޮތުން މިއީ ބިރުވެރި ހިތި ތަޖުރިބާތަކެއް ކުރަންޖެހިދާނެ ކަމެކެވެ. އަދި ހަމައެހެންމެ މިކަމުން ނުކުންނަ ނަތީޖާވެސް ގިނަފަހަރު ރަގަޅެއް ނުވާނެއެވެ.

2- ބަރުލަމާނީ ނިޒާމުގައި ކޮންމެވެސް އެއް ޕާޓީއަކުން ޤާނޫނުހަދާ މަޖްލީހުގެ އަޣުލަބިއްޔަތު ހޯދުމީ ވަރަށް މުހިއްމުކަމެކެވެ. ސަބަބަކީ އެހެންނޫނީ ޤާނޫނު ހަދާ މަޖްލީހުގެ އަޣުލަބިއްޔަތު ހޯދަންޖެހެނީ އެހެން ޕާޓީތަކާއި ގުޅިގެނެވެ. މި ގޮތަށް ގިނަ ޕާޓީތައް އެކުވެގެން އުފެދޭ އެއްބައިވަންތަ ކަމުގެ ސަރުކާރެއް މާގިނަދުވަހަށް ދެމިގެން ދިއުމަކީ ނާދިރުކަމެކެވެ. ހަމަ އެއާއި އެކު ސަރުކާރާއި ޕާޓީގެ ޕޮލިސީ ދަމަހައްޓަން ވަރަށް ދަތިވާނެއެވެ. އަދި ސަރުކާރު ހިންގުމުގައި ވަރަށް ބޮޑެތި ތަކުލީފުތައް އުފުލަން ޖެހޭނެއެވެ. އަވަސް އަވަހަށް ސަރުކާރުވެއްޓި ، ކަނޑައެޅިފައި އޮންނަ މުއްދަތަށްވުރެ ކުރިން އިންތިހާބުތައް ބާއްވަން ޖެހޭތަން އާދެއެވެ.

3- ބޮޑުވަޒީރަށް ލިބިފައިވާ ބާރުތަކުގެ ސަބަބުން އޭނާއަށް ފެންނަގޮތަށް ކަންކަން ރާވާ ހިންގައެވެ. މިކަމުގެ އެންމެ ބޮޑު ސަބަބަކީ ޤާނޫނު ހަދާ މަޖިލީހުގައި އެބޭފުޅާއަށް ލިބިފައިވާ ބާރެވެ. މަގާމެވެ. ބޮޑުވަޒީރަށް ކިތަންމެ ވަރަކަށް މަޖްލީހުގައި ފާޑުކީ ކަމުގައި ވިއަސް އޭނާގެ ކޮޅު ދިފާއުކޮށް ވާހަކަދައްކަން ޤާނޫނު ހަދާ މަޖްލީހުގައި އަޣުލަބިއްޔަތު ލިބިފައިވާ އެބޭފުޅާގެ ޕާޓީގެ މެންބަރުންނާއި އެބޭފުޅާއަށް އިޚުލާސްތެރި ވަޒީރުން ދެމިތިބޭނޭ ކަމުގެ ޔަޤީންކަން އޮންނާނެއެވެ. އެހެން ކަމުން ސަރުކާރުގެ ނިންމުންތަކާއި ދެކޮޅަށް އިދިކޮޅު ޕާޓީތަކަށް ކުރެވޭނޭ އެއްވެސް ކަމެއްނޯވެއެވެ. މިފަދަ ނިޒާމެއްގައި އިދިކޮޅު ޕާޓީއަށް ކުރެވޭހާވެސް ކަމަކީ މައި ސަރުކާރަށް ފާޑުކިއުމެވެ. އެހެން ކަންތައް ދިމާވުމުގެ އެންމެބޮޑު ސަބަބަކީ ޤާނޫނު ހަދާ މަޖިލީހުގައި ހުރިހާކަމެއްވެސް ނިންމަނީ ވޯޓުލައިގެން އަޣުލަބިއްޔަތަށް ތަބާވެގެން ކަމަށްވާތީއެވެ. އެހެންކަމުން މިފަދަ ސަރުކާރެއްގައި ބޮޑުވަޒީރަށް ހުދުމުހްތާރު ވެރިން ވެރިކަން ހިންގާ ބީދައިން ވެރިކަންކުރެވެއެވެ. މިސާލަކަށް 1997 އަހަރު ލޭބަރ ޕާޓީއަށް (މިހާރު ނިއު ލޭބަރ) އިގިރޭސި ޤާނޫނު ހަދާ މަޖިލީހުގައި ލިބުނު ހީނުކުރާ ބޮޑު ކާމިޔާބީގެ ސަބަބުން ޕާޓީގެ ލީޑަރ ޓޯނީ ބްލެޔަރ ގެ އަމަލުފުޅުތައް ހުރީ ރައްޔިތުންގެ ވިންދާ އެއްކޮޅަކަށް ނޫނެވެ. މިކަމުގެ މިސާލެއްގެ ގޮތުން އިގިރޭސި ސިފައިން ރައްޔިތުންގެ ރުހުމާއި ނުލައި އިރާޤަށް ފޮނުވުން ހިމެނެއެވެ.

4- ބަރުލަމާނީ ނިޒާމެއްގައި އިދިކޮޅު ޕާޓީ ވަރަށް ޒިންމާ ކުޑަ ގޮތެއްގައި ހަރަކާތްތެރި ވާތަން ގިނަ ގިނައިން ފެންނާނެއެވެ. މިކަމުގެ އެއް ސަބަބަކީ އެމީހުންނަށް އޮންނަ ހަމައެކަނި ކަމަކީ ސަރުކާރުގެ ސިޔާސަތަށް ފާޑުކިއުމާއި ސަރުކާރާއި ދެކޮޅަށް ކަންކަމުގައި ތެދުވުމެވެ. އަނެއް ސަބަބަކީ އިދިކޮޅު ޕާޓީން ކިތަންމެ މޮޅު ،ފައިދާހުރި ހުށަހެޅުމެއް ހުށަހެޅި ކަމުގައިވިޔަސް އެ ހުށަހެޅުން ފާސްކުރުމަށް އެމީހުންނަށް ކުރެވޭނޭ ކަމެއްނެތުމެވެ. މިގޮތުން ބައެއްފަހަރު ސަރުކާރުން ހުށަހަޅާ ރަގަޅު ފައިދާހުރި ހުށަހެޅުންތަކަށް ވެސް އިދިކޮޅު ޕާޓީން ފާޑުކިޔާ ދެކޮޅުހަދައެވެ. މިހެން ހެދުމުގެ އަސްލު ސަބަބަކީ ވެރިކަންކުރާ ޕާޓީއަށް ޖެއްސުންކޮށް އެމީހުން މަޖިލީހުގެތެރޭ ހާރުވާލުމެވެ. އެހެންކަމުން ޤާނޫނުހަދާ މަޖްލިސް ސިފަކުރެވެނީ ރައްޔިތުންނަށް ފައިދާހުރި ބަހުސްކުރެވޭ މައިދާނަކަށް ވުރެން ބޮޑަށް ޕާޓީތަކުގެ ހަމަލާ ބަދަލުކުރެވޭ ހަނގުރާމައިގެ ހޫނުގަދަ މައިދާނެއްގެ ގޮތުގައެވެ.

5- ހުރިހާ ކަންތައްތައް އާހިރުގަ ނިމޭނީ ވެރިކަންކުރާ ޕާޓީއަށާއި އެޕާޓީއަށް ނިސްބަތްވާ މެންބަރުންގެ މަސްލަހަތަށް އެންމެ ފައިދާހުރި ގޮތަށެވެ. މި ގޮތަށް ކަންތައްތައް ދާވަގުތުތަކުގައި ޤައުމާއި ރައްޔިތުންގެ މަތިން ހަނދާންނެތެއެވެ. މިކަމުގެ ނަތީޖާއަކަށްވަނީ ޤައުމުގައި ކޮރަޕްޝަންގެ ބަލި އަށަގަނެ ބޮޑެތި އިގްތިސާދީ ، އިޖްތިމާއީ މައްސަލަތައް އާންމުވާން ފެށުމެވެ.

6- މިފަދަ ސަރުކާރެއްގައި ވަޒީރުންގެ ގޮތުގައި ތިބޭނީ ބޮޑުވަޒީރު ގަޔާވާ ހިތްއެދޭ ބޭފުޅުންނެވެ. މި ބޭފުޅުން ގިނަވަގުތު ހޭދަކުރައްވާނީ ޕާޓީ ބައްދަލުވުންތަކުގަޔާއި ކެންޕޭނުކުރުމުގަޔާއި އެބޭފުޅަކު ހޮއްވެވި އަވަށެއްގެ (ކޮންސްޓިޓުއެންސީ) ރައްޔިތުންގެ ކަންތައްތައް ހަމަޖައްސައި ދިނުމުގެ މަސަތްކަތުގައެވެ. އެހެންކަމުން މިބޭފުޅުން ހިންގުމާއި ހަވާލުވެ ހުންނަވާ މިނިސްޓްރީގައި ކަންތައްތައް ހިނގާ ދާގޮތް ގިނަފަހަރަކަށް އެގިވަޑައި ނުގަންނަވާނެއެވެ. ދެން އެމަސައްކަތްތައް ރާވާ ހިންގަން ހަވާލު ކުރާނީ މިނިސްޓްރީގެ ކޮންމެވެސް ވެރިއަކާއެވެ. މިހެން ގޮސް މިނިސްޓްރީގެ މަސައްކަތް ބޮއްސުންލާދާނެއެވެ.

7- މިނިޒާމުގައި ބޮޑުވަޒީރުގެ ވެރިކަމުގެ ދައުރު ނުވަތަ މުއްދަތު ކަޑައެޅިގެން ބަޔާންވެފައެއް ނޯންނާނެއެވެ. އެހެންކަމުން ވެރިކަމުގައި ކިތަންމެ ދުވަހެއް ވަންދެންވެސް ހުރުމުގެ ފުރުސަތު ބޮޑުވަޒީރަށް ލިބިގެންވެއެވެ. މިސާލަކަށް އިގިރޭސި ބޮޑުވަޒީރު މާގްރެޓް ތެޗަރ 12 އަހަރު ބޮޑުވަޒީރުކަންކުރެއްވިއެވެ. ޕާޓީގެ ލީޑަރެއްގެ ގޮތުގައި 16 އަހަރު ހުންނެވިއެވެ. ޖޯން މޭޖަރ 07 އަހަރު ވަންދެން ބޮޑުވަޒީރުކަން ކުރެއްވެވިއެވެ. ޓޯނީ ބްލެޔަރ 10 އަހަރުވަންދެން ބޮޑުވަޒީރުކަން ކުރައްވައި 13 އަހަރު ވަންދެން ޕާޓީގެ ލީޑަރެއްގެ ގޮތުގައި ހުންނެވިއެވެ.

8- ރައްޔިތުންނަށް ސީދާ އެބައިމީހުންގެ ވޯޓަކުން ސަރުކާރުގެ އެންމެ އިސްވެރިޔާ ހޮވުމުގެ ފުރުސަތެއް ނޯވެއެވެ. އެހެންކަމުން އޭރު ހުންނެވި ބޮޑުވަޒީރަކު އިސްތިއުފާ ދެއްވުމުން އެމަޤާމަށް ދެންއަންނަ ބޮޑުވަޒީރަކު އަންނާނީ އެބޭފުޅަކު ނިސްބަތްވާ ޕާޓީއެއްގެ ޤާނޫނު ހަދާ މަޖިލީހުގެ ގިނަ މެންބަރުންގެ ތާއީދު ލިބޭ ބޭފުޅެކެވެ. މިސާލަކަށް އިގިރޭސި ކުރީގެ ބޮޑުވަޒީރު ޓޯނީ ބްލެޔަރ އިސްތިއުފާ ދެއްވުމުން މިހާރު ބޮޑުވަޒީރުކަމުގެ މަޤާމަށް ހޮވިވަޑައިގެންނެވި ކުރީގެ ޗާންސެލަރ ގޯޑަން ބްރައުން އެމަގާމާއި ހަވާލުވީ އެއްވެސް އިންތިހާބެއްގައި ވާދަކުރުމެއްނެތިއެވެ. މިނިޒާމު ހަމަޖެހިފައިވާ ގޮތުން ބޮޑުވަޒީރަކާއި ރައީސަކު އެބަހުންނަން ޖެހެއެވެ. މިހެންވުމުގެ ސަބަބުން ދައުލަތުގެ ހަރަދުގައި ރައީސް /ރާނީ އާއީ އެބޭފުޅާގެ އާއިލާއަށް ތާހިރު، އަބުރުވެރި ދިރިއުޅުމެއް އުޅެވޭނޭފަދަ ގޮތެއް ހަމަޖައްސައިދޭން ޖެހޭނެއެވެ. މިހެންވުމުން ދައުލަތުގެ ޚަރަދު ވަރަށް ބޮޑުތަން އިތުރުވެދެއެވެ. މިސާލަކަށް އިގިރޭސި ވިލާތުގައި ދައުލަތުގެ ވެރިޔާއަކީ ރާނީ އެލިޒަބަތެވެ. އެކަމަނާ ދިރިއުޅުއްވުމަށް ދައުލަތުން ދެއްވާފައިވަނީ މަޝްހޫރު ބަކިންހަމް ޕެލަސްއެވެ. ބޮޑުވަޒީރުގެ ގަނޑުވަރު އަދި ގެކޮޅުގެ ގޮތުގައި ދައުލަތުން ހަމަޖައްސަވާފައިވާނީ ނަންބަރ 10 ޑައުނިން ސްޓްރީޓްއެވެ.

މިނިޒާމުގައި ރަގަޅު ކަންތައްތަކެއް ހުރިހެން މި ނިޒާމުގައި ގޯސް އުނި ކަންތައްތަކެއް އެބަހުރިކަން މިހާރު އަޅުގަޑުމެން އެންމެނަށްވެސް އެގެއެވެ. ނިންމާލަމުން ބުނަންއޮތީ ބަރުލަމާނީ ނިޒާމުގެ ދަށުން ކާމިޔާބު ވެރިކަން ހިންގާ ނިޒާމެއް ގާއިމްކުރެވޭނީ އެ ޤައުމެއްގައި ހަރުދަނާ ބައި- ޕާޓީ (ބޮޑު ދެ ޕާޓީ) ސިސްޓަމެއް އޮވެ "އިޚުލާސްތެރި" ކަމާއިއެކު މަސައްކަތް ކުރާ އިދިކޮޅު ޕާޓީއެއް އޮވެގެންނެވެ. ކުދި ކުދި ބައިވަރު ޕާޓީތައް (މަލްޓި ޕާޓީ) ގާއިމްވެފައިވާ ޤައުމެއްގައި މިފަދަ ނިޒާމަކަށް އެއްވެސް އަލި މަގެއްނުފެންނާނެއެވެ. އެފަދަ ނިޒާމެއްވާނީ ރައްޔިތުންގެ ހަލާކަށެވެ.

?The Judas-Act Again

During the middle of last year, I recall writing in the Minivan website that during the coming weeks and months events would conspire to separate the men from the boys.

Events – testing the mettle of those politicians who stood at the vanguard of the democratic movement – presented themselves, but except for the rare person all dismally failed. The fickle and the weak of character were weaned out. Even those like Mohamed Shihab who claimed to have served in the Peoples’ Majlis for over 20 years failed miserably.

Whilst committed party stalwarts remain steadfast in their pledge to democracy and think nothing of sacrificing their liberty and others brave severe financial hardship, other people have gone down the bankruptcy lane. All propelled by the hope of dismantling a dictatorship hell-bent on systematically bleeding the country dry, the previously buried snakes in the grass of the democracy movement, lifted their ugly heads, conspiring to inject venom into the aspirations of dedicated activists.

By openly coming out in public to condemn a MDP National Council resolution, which they themselves had previously backed by voting in favour, fully aware of the implications of the decision, the majority of the MDP Parliament members, by doing an about-face, have effectively ruined the party's chances of winning the concessions President Gayoom would have been forced to concede.

The 10th November debacle could not have occurred at a less inopportune moment. Even if we of the MDP disregard the direct damages sustained we still have another major hurdle to cross.

Having opted for the Parliamentary system over the Presidential system, we may be in one sense, headed straight towards another yawning chasm, a bottomless abyss from which we may have difficulty in rescuing ourselves.

By referring to the Parliamentary Wing as a single entity, I do realise I may be perpetrating a grave injustice to those members who fought against participation in the plans concocted to derail the gathering of the 10th by certain MP’s and other turn-coats who backed them.

If my assumptions are right, by opting for a Parliamentary system, we are once again placing our fates directly in the hands of the very same people who wrecked the plans for the 10th November gathering.

Speaking for myself (I believe that my thinking is in line with the average party member), I’m prepared to accept any democratic system – whether it be Parliamentary or Presidential – so long as it serves the purpose. That is - rid the nation of Gayoom, who has propelled the nation into a financial black-hole by squirreling away large chunks of public money, the product of years of sweat and toil of our working class.

Furthermore he has put our great-grandchildren into debt too. Even tsunami funds are not exempt. It is allegedly being used to line the pockets of public officials. Public money is spent freely on almost every trivial pursuit known to man including the elevation of the President’s eyebrows which currently stands just millimeters below the hairline.

It shames me to admit ignorance when it comes to discussing the pros and cons of both Presidential versus Parliamentary system and therefore I’d be happy enough to follow the astute advice of professionals. The question may actually be academic by now; if my information is right the MDP has passed a resolution opting for the Parliamentary system, and the campaign, though yet to gather full momentum, has already begun.

To even begin to conceive that it would be in the interest of the elected members of the Majlis to complete re-writing the new Constitution would be indeed foolish. The Majlis members are heavily paid by Gayoom to warm their seats.

The way things stand now, the advantage lies with both Gayoom and the Majlis members. Should the new Constitution be completed, one group of Majlis members would lose their jobs and the perks that go with the job, while the other group, in all likelihood, would have to face fresh elections. The entire exercise at loggerheads with the needs of the public.

If by chance the MDP should fall under the sway of the very same Parliamentarians, who had miserably failed to honour their given word, it would indeed be a sad occasion.

Writers for Presidential System

A number of writers have argued for introduction of a Presidential System in the Maldives. Abdulla Shinan has written for Adduvas magazine while Ibrahim Moosa Fulhu has written for Fiyes, explaining the merits of Presidential System.

Some of those articles were written back in 2006 when there was more room for a balanced debate on the two systems. However, it is the propaganda that is prepared by MDP, Minivan Daily and weekly magazines dominates now. Even though few writers still write to mainstream media on the merits of a Presidential System it is difficult to hear their voices because they are drained by the noise of the propaganda.

In the coming days we will publish articles written by Maldivian writers arguing for a Presidential System as well as articles explaining how the two systems work. We hope that by reading those articles you will see some new perspectives other than what the political parties and their media tell us.

No need to celebrate

Today is our Independence Day. But there is no need to celebrate. Despite the flags on the streets and lights on buildings we do not have freedom.

Even as some Maldivians celebrate, a journalist is in prison. Three years after the death of Eavan Naseem, torture is still being used as a tool for repression. Thousands of people are living below poverty line in the islands. In the capital Male’ decent housing is not affordable and not available.

Why are we at this pathetic state?

There are several reasons why the regime is able to oppress us. One reason is there is no separation of powers. The regime has been keeping the judiciary under its control, denying us justice. It has been keeping the parliament under control through appointed members, ministers and cronies.

Why did our parliament vote unanimously to keep a dictator in power in 2003 even before a week passed after Eavan Naseem was tortured to death? It is because our parliament members do not care about us.

Some of the MPs who voted for Gayoom that day are now labeled as reformists. They are in the guise of reformist MPs belonging to the ‘opposition’ MDP.

With the televising of Parliament and Constituent Assembly sessions Maldivian public are seeing the true colours of our MPs. They are wasting time, arguing over trivial matters and enjoying their salaries. Do you want to give more powers to such a body?

Do you want to bring a system in which the Executive is appointed by the Parliament? Do you want to bring a system in which the powers of the Executive overlap with that of Parliament? Do you want to bring a system in which the majority party MPs will pass Laws as they wish in the Parliament and have the powers of the Executive in their hands as well?

Keep the Parliament where it belongs. Let the MPs make legislation and scrutinize the powers of the Executive. But do not let them enjoy the powers of Executive as well. Do not allow Cabinet Ministers to be in our Parliament.

Vote for a system that separates the powers of the Executive, Parliament and the Judiciary. Vote for Presidential System. Vote for Separation of Powers.

ސަލީމް އެބުނާ ފަސް ގޮނޑިއަށް ފަސް މީހުން ކަނޑައެޅީ ކޮން ބަޔަކު ތިބެގެން ނިންމި ގޮތެއްގެ މައްޗަށް ބިނާކޮށް ހެއްޔެވެ؟ އެކަން ނިންމީ އެމްޑީޕީގެ ގައުމީ މަޖިލީހުން ހެއްޔެވެ؟ އެކަން ނިންމި ބަޔަކު ނިންމާފައި އޮތް އިރު އެ ފަސްމީހުންގެ ނަންތައް މީޑިއާއަށް ހާމަކޮށްފައި ނެތީ ކީއްވެ ހެއްޔެވެ؟ އެކަން ނިންމުމުގައި ގދ. ދާއިރާގެ އެމްޑީޕީ މެންބަރުންގެ މަޝްވަރާ ހޯދާފައި ވަނީ ކިހާ މިންވަރަކަށް ހެއްޔެވެ؟

ގދ. އަތޮޅުގެ ގިނަ ރައްޔިތުންނަކީ އެމްޑީޕީގެ މެންބަރުން ނުވަތަ އެމްޑީޕީއަށް ވޯޓު ދޭނެ މީހުންނެވެ. އެމީހުންގެ މުސްތަގުބަލު ކަނޑައެޅުމުގައި މަޖިލީހުގައި މަސައްކަތް ކުރާނެ މެންބަރުން ހޮވުމަށް ބާއްވާ އިންތިހާބެއްގެ ކެންޑިޑޭޓުން ޕާޓީން ކަނޑައަޅަން ވާނީ އެމީހުންނާއި ވެސް މަޝްވަރާ ކޮށްފައެވެ.

ސަލީމް ހާމަ އެކުރީ އެމްޑީޕީގެ ކަންތައް ހިގަނީ ޓްރާންސްޕޭރެންޓް ކޮށް ނޫން ކަމެވެ. ޑިމޮކްރެސީ ގެނައުމުގެ ނަމުގައި މަސައްކަތް ކުރާ އެ ޕާޓީގެ ގިނަ ކަންތައް މަދު ބަޔަކު ނިންމައި ސިއްރުކޮށްގެން ތިބޭ ކަމެވެ. އެބުނާ ފަސް މީހުންނަކީ މުއްސަދިން ހެއްޔެވެ؟ އަދި އެމީހުންގެ ފަހަތުގައި ތިބީ ކޮން ބައެއް ހެއްޔެވެ؟ އެމްޑީޕީ އިން ބަރުލަމާނީ ނިޒާމެއް ރާއްޖެއަށް ގެނެސް މަޖިލީހުގެ ގޮނޑިތަކަށް މެންބަރުން ހޮވުމުގައި ރައްޔިތުންގެ ބަސް މިހާ ކުޑަކުރަން ރާވަނީ އެމީހުންގެ ވަރަށް ބޮޑު ރޭވުމެއްގެ ދަށުން ވަކި ބަޔަކަށް ބާރުތައް ދީ، މަޖިލީހުގެ ގޮނޑިތައް ހޯދައިދޭން ހެއްޔެވެ؟

އިގިރޭސިވިލާތުގައި ވެސް ޕާޓީގެ ފަރާތުން ދާއިރާތަކަށް ކެންޑިޑޭޓުން ހޮވުމުގައި އަމަލު ކުރާ އުސޫލުތައް އެމްޑީޕީގެ އުސޫލުތަކާއި ތަފާތެވެ. އެމްޑީޕީ އާއި ގާތް ގުޅުމެއް އޮންނަ އިގިރޭސި ކޮންޒަވޭޓިވް ޕާޓީއިން އަމަލު ކުރާ އުސޫލު ބައްލަވާށެވެ. ލިބަރަލް ޑިމޮކްރެޓިކް ޕާޓީ އިން އަމަލު ކުރާ އުސޫލު ބައްލަވާށެވެ. 2003 ވަނަ އަހަރުގެ އިންތިހާބުގައި ސްކޮޓްލެންޑްގެ ޕާލަމެންޓަށް މެންބަރުން ހޮވުމަށް ޕާޓީތަކުން ކެންޑިޑޭޓުން ހޮވި ގޮތް ބައްލަވާށެވެ.

އެމްޑީޕީގެ ފަރާތުން ތައްޔާރުކޮށްފައި ތިބި ފަސް މީހުންގެ ތެރޭގައި އަންހެނުން ހިމަނާފައިވޭ ހެއްޔެވެ؟ ޖެންޑަރ ހަމަހަމަ ކުރުމަށް އިސްކަން ދީފައިވޭ ހެއްޔެވެ؟

Court orders Atolls Ministry to compensate activist

A political and human rights activist who was fired from her post at Atolls Ministry in November 2006 has won a court case claiming compensation for unfair dismissal. The Civil Court ruled on Sunday that the Atolls Ministry should pay Zaheena Rasheed Rf16,000 as compensation.

Zaheena was fired after she attended a Maldivian Democratic Party (MDP) demonstration as an interpreter for foreign observers invited by Maldivian Detainee Network.

Paul Roberts from Minivan News reports on the ruling:

In December, although she says “I received no encouragement and was told I didn’t stand a chance,” Zaheena made history by becoming the first person to sue the government for wrongful dismissal. And on Sunday she was vindicated when Judge Abdullah Hameed found she had not broken any of her terms of employment.

The Court's ruling in favour of Zaheena creates a precedent for other workers who have been treated unfairly to lodge similar cases to claim compensation. However, it remains to be seen if the judicial system in the Maldives - which has been under the tight control of the executive during the Gayoom regime with no separation of powers - will deliver justice to hundreds of workers who have been unfairly treated by employers.

Zaheena has nevertheless created an example for workers to fight the injustices of the government.

ބަރުލަމާނީ ނިޒާމެއްގައި އިންދިރާ ގާންދީ 16 އަހަރު ވެރިކަން ކުރައްވާފައިވޭ

ރާއްޖޭގެ އަވައްޓެރި އިންޑިޔާއަކީ ބަރުލަމާނީ ނިޒާމެއް އޮންނަ ގައުމެކެވެ. އެގައުމުގައި އޮންނަ ބަރުލަމާނީ ނިޒާމުގެ ދަށުން ޖަވާހަރުލާލް ނެހެރޫ 17 އަހަރު ބޮޑުވަޒީރުކަން ކުރެއްވިއެވެ. އެއީ 15 އޯގަސްޓް 1947 ވަނަ ދުވަހުން ފެށިގެން 27 މޭ 1964 ވަނަ ދުވަހާއި ހަމައަށެވެ. އެއީ ނެހެރޫ އަވަހާރަވި ދުވަހާއި ހަމައަށެވެ. ނެހެރޫގެ އަންހެން ދަރިކަނބަލުން އިންދިރާ ގާންދީ އިންޑިޔާގެ ބޮޑުވަޒީރުކަން 16 އަހަރު ވަންދެން ކުރައްވާފައިވެއެވެ. އެއީ 24 ޖެނުއަރީ 1966 ވަނަ ދުވަހުން ފެށިގެން 24 މާޗް 1977 ވަނަ ދުވަހަށް އަދި 14 ޖެނުއަރީ 1980 ވަނަ ދުވަހުން ފެށިގެން 31 އޮކްޓޯބަރ 1984 ވަނަ ދުވަހާއި ހަމައަށެވެ. އިންދިރާ ގާންދީ އަވަހާރަކޮށްލީ ބޮޑުވަޒީރަކަށް ހުންނަވަނިކޮށެވެ. ބައްޕައާއި ދަރިފުޅުގެ ބޮޑުވަޒީރުކަމުގެ ޖުމްލަ މުއްދަތަކީ 33 އަހަރެވެ.

އިންދިރާ ގާންދީގެ ފަހުން ބޮޑު ވަޒީރަކަށް ވެވަޑައިގެންނެވީ އޭނާގެ ފިރިހެން ދަރިކަލުން ރަޖީވް ގާންދީއެވެ. އޭނާ 5 އަހަރު ވަންދެން ބޮޑުވަޒީރުކަން ކުރެއްވިއެވެ. އެއީ 31 އޮކްޓޯބަރ 1984 ވަނަ ދުވަހުން ފެށިގެން 1 ޑިސެމްބަރ 1989 ވަނަ ދުވަހަށެވެ.

އިންޑިޔާގެ ބަރުލަމާނީ ނިޒާމުގައި ބޮޑުވަޒީރަކަށް ވުމުގެ ފުރުސަތު ރަޖީވް ގާންދީގެ ހުވަފަތް އަނބިކަބަލުން ސޯނިއާ ގާންދީއަށް ވެސް ލިބިވަޑައިގަތެވެ. ނަމަވެސް އޭނާ އެފުރުސަތު ދޫކޮށްލެއްވީއެވެ. ރަޖީވް ގާންދީގެ ދަރިކަލުން ރާހުލް ގާންދީ އަކީ މުސްތަގުބަލުގެ ބޮޑުވަޒީރަކަށް ވާނެ ކަމަށް ގިނަ ބަޔަކު ދެކެއެވެ.

އިންދިރާ ގާންދީގެ ބޮޑުވަޒީރުކަމުގައި 26 ޖޫން 1975 ވަނަ ދުވަހު އިއުލާން ކުރި ސްޓޭޓް އޮފް އެމަޖެންސީއަކީ ހުދުމުހުތާރު ބާރުތަކާއި އެކީގައި ވެރިކަން ކުރުމަށް އޭނާ ހުޅުވާލި ދޮރެކެވެ. މިދުވަސްވަރު ސަރުކާރާއި ދެކޮޅު ވަރަށް ގިނަ މީހުން ޖަލަށްލިއެވެ. ނޫސްތައް ސެންސަރުކުރުން ހައްދު ފަހަނަޅާ ދިޔައެވެ. އަދި އާބާދީ މަދުކުރުމުގެ ނަމުގައި ގަދަބާރުން މަޖުބޫރުކޮށްގެން ފިރިހެނުންނަށް ދަރިން ނުލިބޭ ގޮތް ވެސް އެދުވަސްވަރު ހެދިއެވެ. އެ ދުވަސްވަރުގެ ހާލަތު ކޮންމެވެސް ވަރަކަށް ސަލްމާން ރުޝްދީގެ މިމަޒުމޫނުގައި ވެސް ކިޔާދީފައިވެއެވެ. އަދި ސަލްމާން ރުޝްދީގެ ވާހަކަ ފޮތް 'މިޑްނައިޓްސް ޗިލްރަން' ގައި އުޅޭ ސަލީމް ސިނާއީއަށް ވެސް އިމަޖެންސީގެ އުދަގޫތައް ފޯރައެވެ. އިމަޖެންސީ ވެރިކަމުގެ ކަންތައް އެންމެ ރަގަޅަށް ބަޔާންކޮށްދޭ އެއް ވާހަކަ ފޮތަކީ ރޮހިންތަން މިސްތްރީގެ 'އަ ފައިން ބެލެންސް' އެވެ.

ދާދިފަހުން އެމްޑީޕީގެ ފަރާތުން ބަރުލަމާނީ ނިޒާމަށް ތާއީދު ހޯދުމަށް ހއ. ދާއިރާއިން އިންތިޒާމުކުރި ބައްދަލުވުމެއްގައި މާލޭގައި ދަރުބާރުގޭގައި އެޕާޓީގެ ޗެއަރޕާސަން މުހައްމަދު ނަޝީދު ދެއްކި ވާހަކައިގައި އިންޑިޔާގެ އެމަޖެންސީ ދުވަސްވަރަށް ފަހުގައި އިންޑިޔާގައި ރިޔާސީ ނިޒާމު ގެނައުމަށް ދެކޮޅު ހަދައި ރިޔާސީ ނިޒާމަކީ ގައިރުގާނޫނީ ނިޒާމެއް ކަމަށް އިންޑިޔާގެ ކޯޓަކުން ހުކުމެއް ކޮށްފައިވާ ކަމަށް ބުންޏެވެ.

އިންދިރާ ގާންދީގެ އިމަޖެންސީ ވެރިކަން ފެއްޓީ ވެސް އޭނާ އިންތިހާބުގައި ނުފޫޒުގެ ބޭނުންކޮށްފައިވާ ކަމަށާއި އިންތިހާބުގެ ނަތީޖާ ސައްހަ ނޫން ކަމަށާއި އޭނާއަށް މަޖިލީހުން ލިބުނު ގޮނޑި ދޫކޮށްލަން ޖެހޭނެ ކަމަށް އިންޑިޔާގެ ކޯޓަކުން ހުކުމް ކޮށްފައި ވަނިކޮށެވެ.

މީގެ ތިން އަހަރު ކުރިން ރާއްޖޭގައި ވެރިކަމުގެ ތިންބާރު ވަކިކުރުމުގެ ރޫހު ވަރަށް ގަދަޔަށް އޮތް ނަމަވެސް މިހާރު އެއީ އެހާ މުހިންމު ކަމެއް ކަމަކަށް އެމްޑީޕީއަކުން ނުދެކެއެވެ. އަންނި ދެއްކި ވާހަކައިގައި މުހިންމީ ސަރުކާރާއި ދައުލަތް ވަކިކުރުން ކަމަށް ބުންޏެވެ.

"ރިޔާސީ ނިޒާމެއްގައި އެބާރުތައް ވަކިވަނިއްޔޭ އަދި ބަރުލަމާނީ ނިޒާމެއްގައި އެބާރުތަކެއް ވައްކެއް ނުވެޔޭ، އަޅުގަނޑަކަށް އެކަމެއް ގަބޫލެއް ނުކުރެވޭ އެއީ އިލްމީ ގޮތުންވެސް ބާތިލް ވާހަކައެއް، އެއީއެއްނޫނޭ ވަކި ކުރަންވީ ބާރަކީ ވަކިކުރަންވީ ބާރަކީ ސަރުކާރާއި ދައުލަތާއޭ، ބަރުލަމާނީ ނިޒާމެއްގައި ވެސް ވަކިވެފައި އޮންނަ ތިންބާރެއް އޮވެޔޭ އެއީ ސަރުކާރުގެ ބާރު ބޮޑު ވަޒީރަށް، ދައުލަތުގެ ބާރު ރައީސުލްޖުމްހޫރިއްޔާއަށް، ޝަރީއަތުގެ ބާރު އުއްތަމަ ފަނޑިޔާރު" އަންނި ވިދާޅުވިއެވެ.

އަންނިގެ ވާހަކައިގައި "ރިޔާސީ ނިޒާމަކީ ހަގީގަތުގައި ވެސް ޑިމޮކްރެސީއާއި ގުޅޭ ނިޒާމެއް ނޫން ކަމަށް" ވެސް ބުންޏެވެ.

އަންނި މިވާހަކަ ދައްކާފައި ވީ ނަމަވެސް ބަރުލަމާނީ ނިޒާމެއް އޮންނަ ގައުމެއް ކަމަށްވާ އަދި އަންނި ކިޔެވި ގައުމު ކަމަށްވާ އިގިރޭސި ވިލާތުގައި އުޅެފައިވާ އަންނިއަށް ވުރެ އިލްމީ ގޮތުން މާމޮޅު ކަމަށް ދުނިޔޭގެ ގިނަ ބަޔަކު ގަބޫލުކުރާނެ މީހުން ވެސް ވަނީ ބަރުލަމާނީ ނިޒާމެއްގައި ވެރިކަމުގެ ބާރުތައް މުޅިން ވަކި ނުވާ ކަމަށާއި، ވެރިކަމުގެ ބާރުތައް ވަކިކުރުމުގެ މުހިންމު ކަމުގެ މައްޗަށް ލިޔެ ވާހަކަދައްކާފައެވެ. ބަރުލަމާނީ ނިޒާމެއްގައި އަގުލަބިއްޔަތު ލިބޭ ޕާޓީ ރައްޔިތުންގެ މަޖިލީހުގެ މައްޗަށް ނުފޫޒު ފޯރުވާ ގޮތާއި މެދު ލޯޑް ހެއިލްޝަމް ބުނެފައިވަނީ "އިލެކްޓިވް ޑިކްޓޭޓަރޝިޕެއް" ކަމަށެވެ. އަދި އިންޑިޔާގައި އޮންނަ ބަރުލަމާނީ ނިޒާމުގެ މައްސަލަތައް ފާހަގަކޮށް ރިޔާސީ ނިޒާމެއް ގެނައުމަށް ގޮވާލާ މީހުން ވެސް އެބަތިއްބެވެ.

ބަރުލަމާނީ ނިޒާމަކަށް ކެމްޕޭން ކުރަމުން ގެންދާ އެމްޑީޕީ އިން ދަނީ ރައްޔިތުންނަށް އޮޅުވާލައި ގިނަ ދޮގުތަކެއް ހަދަމުންނެވެ. އަދި މިކަމުގައި އެމްޑީޕީގެ މައުތުޕީސް 'މިނިވަން' ކަމަށް ބުނާ އެކަމަކު މިނިވަން ނޫން ނޫސް ވެސް ދަނީ ފުރިހަމައަށް ބައިވެރިވަމުންނެވެ. މިގޮތުން މިހާރު ރާއްޖޭގައި ހިގަމުންދާ ހުދުމުހުތާރު ވެރިކަމަކީ ރިޔާސީ ނިޒާމެއް ކަމަށް ރައްޔިތުންނަށް ވިސްނާދީ ވަރަށް ބޮޑަށް އޮޅުވާލަމުން އެބަ ގެންދެއެވެ. މިއީ މިގަރުނުގައި ދިވެހިރާއްޖޭގައި ހިގާ އެންމެ ބޮޑު އޮޅުވާލުމަށް ވެސް ވެދާނެއެވެ.

އިސްލާހު ގެނައުމުގެ ބޭނުމުގައި އެމްޑީޕީއަށް ތާއީދުކުރި ކިތަންމެ ބަޔަކު މިހާރު ވަނީ މާޔޫސްވެފައެވެ. އަދި އެމީހުން ބުނާ ގޮތުގައި އެމްޑީޕީ ބޭނުންނަމަ ބަރުލަމާނީ ނިޒާމަކަށް ތާއީދު ކުރެވިދާނެއެވެ. ނަމަވެސް ރައްޔިތުންނަށް ކޮންމެހެން އޮޅުވާލާކަށް ނުޖެހެއެވެ. މައުމޫނުގެ ވެރިކަން ހިންގާ ގޮތެކޭ އެމްޑީޕީގެ އަމަލުތަކެކޭ މިކަމުގައި ތަފާތެއް ނެތެވެ.

Jamming for the Islands and the Earth

'Jamming for the Islands', a Friends of Live Earth event is to be held at Alimas Carnival area on 7 July 2007. The music show will begin at 4.00 pm and continue till 12.00 am. There will be a break between 6.00 pm and 8.00 am.

Friends of Live Earth events help people in different countries to be part of a global movement to combat the climate crisis by supporting the Live Earth music festival.

Live Earth is a monumental music event that will bring together more than 2 billion people on July 7, 2007 to combat the climate crisis. Live Earth will stage concerts in New York, London, Sydney, Tokyo, Shanghai, Rio de Janeiro, Johannesburg and Hamburg, and will feature more than 150 of the world’s best music acts – a mix of both legendary music acts like The Police, Genesis, Bon Jovi and Madonna with the latest headliners like Kanye West, Kelly Clarkson, Black Eyed Peas and Jack Johnson.

Live Earth’s 24 hours of music across 7 continents will deliver a worldwide call to action and the solutions necessary to answer that call. Live Earth marks the beginning of a multi-year campaign to drive individuals, corporations and governments to take action to solve the climate crisis. Live Earth is partnering with the Alliance for Climate Protection, The Climate Group, Stop Climate Chaos and other international organizations in this ongoing effort. Live Earth was founded by Kevin Wall, CEO of Control Room, the company producing the concerts globally. According to the website of Jamming for the Islands the bands that will perform in the local event include Amazon Jade, Traphic Jamm, 1984 and Zero Degree Atoll.

None of the political parties in the Maldives seems to be concerned much about the deteriorating environmental conditions in the country. Islands are being reclaimed and harbours are being dredged without proper Environmental Impact Assessments. The greed of the corporate sector takes dominance over environment as resorts expand their land to build more rooms, altering the natural island dynamics. Poor islanders are left with no choice but mine sand from beaches for construction because river sand and aggregate are too expensive for them. The lack of a good transportation network pushes up the price of any material taken to the islands. Our islands are faced with threat of tidal waves and flooding. To what extent do our parliamentarians raise these issues in the parliament? Shouldn't the government reduce import duties from river sand? Shouldn't the government set up warehouse facilities in islands for river sand? Or should the government just turn a blind eye to sand mining from beaches and blame all beach erosion on global warming and sea level rise? Why did the fine imposed for destroying Vilivaru island reduced so drastically? Who does what at the environment ministry?

Why is it more important for MDP to visit islands and tell the people that the presidential system is just another name for dictatorship rather than inquiring about the pressing environmental issues the islanders face? To what extent has the MDP Parliamentary Group worked on proposing new environmental Bills to parliament?

It is not just enough to jam for the islands and think that the music show will solve everything.

Happy Independence Day to all Americans

On July 4, 1776, the United States Declaration of Independence was adopted by the Congress.

"Four score and seven years ago our fathers brought forth on this continent, a new nation, conceived in liberty, and dedicated to the proposition that all men are created equal." President Abraham Lincoln in his Gettysburg Address of 1863.

The main author of the Declaration was Thomas Jefferson, one of the founding fathers of USA.

The preamble of the Declaration reads:

We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.

That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed, That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness.

Prudence, indeed, will dictate that Governments long established should not be changed for light and transient causes; and accordingly all experience hath shewn, that mankind are more disposed to suffer, while evils are sufferable, than to right themselves by abolishing the forms to which they are accustomed. But when a long train of abuses and usurpations, pursuing invariably the same Object evinces a design to reduce them under absolute Despotism, it is their right, it is their duty, to throw off such Government, and to provide new Guards for their future security.

The American Founding Fathers had a vision and were committed to the progress of the nation. Can the same be said of our politicians from various political parties and of our parliamentarians? Our parliamentarians have dismissed the idea of a bicameral parliament without even a proper debate. Our MPs have to be responsible for upholding the dictatorship we have today. The parliament voted unanimously to nominate Gayoom as presidential candidate for a public referendum barely a week after Eavan Naseem was brutally killed in 2003. The influence of the Executive over our Parliament has paved the way for abuses.

The Maldives needs a system with more checks and balances. We need separation of powers. For that what we need is a Presidential System. Contrary to what MDP’s mouthpiece Minivan Daily has been saying, the Maldives has never had a presidential system. Minivan Daily has increased its propaganda in recent weeks trying to make the unsuspecting people believe that the dictatorship in the Maldives is a presidential system. MDP and Minivan Daily’s propaganda has painted presidential system as a system that breeds dictators and encourage tyranny. For the Maldivian public, presidential system is now becoming synonymous with despotism, thanks to the spin of MDP, a party that claims to be working for democracy in the Maldives.

It is ironic that so-called reformists have cried foul over Gayoom’s ministers sitting in the parliament while they do not object to the idea of ministers being appointed to Cabinet from the parliament in a parliamentary system. It is true that Cabinet members will be elected MPs and not appointed MPs in a parliamentary system. However, we have seen how even elected MPs who are also members of the cabinet act to defend the government.

Our hope is that our young generation sees through the selfish urges of our politicians.

And we would like to wish a very happy Independence Day to the freedom loving people of United States of America, the land of liberty where separation of powers is exercised through a presidential system.
